Michigan Asbestos Diseases and Death Statistics

With an influx of industries that used asbestos heavily before the Environmental Protection Agency (EPA)  imposed regulations, the state of Michigan has an extremely high rate asbestos-related illnesses and deaths when compared to the rest of the United States. It’s currently ranked #9, in fact, for the most asbestos-related deaths in the nation.
Per the Environmental Working Group (EWG), a total of 896 Michigan residents have died from mesothelioma between 1999 through 2008. An additional 140 Michigan residents died from asbestosis during the same time period. The majority of these victims developed asbestos diseases after prolonged exposure to harmful asbestos fibers while working in industries that used the dangerous mineral.

Unfortunately, arrays of industries in Michigan have been linked to asbestos use. The automotive industry, which was founded in Detroit, was one of the biggest sources of asbestos exposure in the state. Everyday, thousands of employees faced asbestos exposure as they lined up in automobile assembly lines and worked several hours per day. The majority of the car parts being assembled were made with asbestos-containing materials (ACMs) up until the early 1980s.
In addition to the automotive industry, people who worked at construction sites, paper mills, hospitals, chemical plants, power plants, and much more were also left vulnerable to the dangerous effects of asbestos. Statutes of Limitations for Asbestos Lawsuits in Michigan

Each state the U.S. has its own statute of limitations when filing lawsuits. In Michigan, a plaintiff who intends to file an asbestos-related lawsuit must file within three years after determining the asbestos exposure. The three-year rule also applies to those that are filing a wrongful death lawsuit. In these instances, the plaintiff must file within three years of the victim’s death.
In addition to the statute of limitations, the plaintiff must be able to successfully demonstrate how and when the asbestos exposure occurred. This rule applies to exposure at job sites or via a product manufacturer. For example, if you’ve been exposed to asbestos after changing the brakes on your car, and the the asbestos in the brakes caused damage to you, you must be able to prove this through documents, medical records, and any other evidence that backs up your claim.

State Laws on Asbestos in Michigan

Michigan has strict rules and regulations when it comes to handling and/or removing asbestos. The Construction Safety and Health Division’s Asbestos Program typically handles most asbestos-related issues, regulations, and laws in Michigan, including the Michigan Occupational Safety and Health Administration ( MOSHA) Regulations, Michigan Public Act 135 of 1986, and Michigan Public Act 440 of 1988. In addition, the OSHA 29 CFR 1926.1101 and the OSHA 29 CFR 1910.1001 is strictly enforced.
Asbestos was regulated in Michigan in 1986 after officials found that many people were dying from mesothelioma, asbestosis, and lung cancer after being exposed to the harmful fibers in asbestos while working around the mineral for too long. As a result, employees, contractors, employers, and anyone else working around and/or handling asbestos must be properly trained.
